§ 1 Scope

These General Terms and Conditions (hereinafter “Terms”) apply to the use of the website tripcart.app and the associated services (hereinafter “Service”) of the provider

by consumers and businesses (hereinafter “User”). Deviating terms of the User shall not be recognised unless the provider expressly agrees to their applicability in writing.

§ 2 Subject matter

The provider currently offers an information and waitlist page at tripcart.app for the planned application TripCart (hereinafter “App”). The User may sign up to the waitlist without obligation and will be notified by email about the launch and related information.

There is no claim to provision, availability, or any specific functionality of the App.

§ 3 Waitlist signup

Signup to the waitlist is carried out by entering a valid email address and confirming via double opt-in. Upon confirmation, a free-of-charge usage relationship regarding the waitlist is established between User and provider.

The User may revoke the signup at any time without giving reasons, for example by email to crew@tripcart.app or via the unsubscribe link in every message.

§ 4 User obligations

The User undertakes to provide truthful information when signing up and, in particular, to provide an email address they themselves control. Signup using third-party email addresses without the corresponding authorisation is prohibited.

§ 5 Availability

The provider endeavours to keep the website available without interruption. However, no specific availability is guaranteed. The provider reserves the right to carry out maintenance and to discontinue the offering in whole or in part.

§ 6 Liability

The provider is liable without limitation for intent and gross negligence as well as under the German Product Liability Act. For slight negligence, the provider is only liable in case of injury to life, body or health or in case of breach of essential contractual obligations (cardinal duties). In the latter case, liability is limited to the typical and foreseeable damage.

§ 7 Privacy

Information on the processing of personal data can be found in the Privacy Policy.

§ 8 Final provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the User is a consumer with habitual residence in another EU member state, the mandatory consumer protection law of that state shall remain unaffected.

If any individual provisions of these Terms are or become invalid, the validity of the remaining provisions shall remain unaffected.
